Zoning out, Lomaz to return fireworks to Deerfield

DEERFIELD — The township’s zoning code is out, and make no mistake about it — Larry Lomaz and Midwest Fireworks are on their way back.

Lomaz, who says his investment company owns the land on U.S. 224 where he operated Midwest Fireworks for many years, says he’s bringing everything back — the fireworks, the concerts, and, no question, the controversy that raged over the business for decades.

“You will see the property cleaned up,” he said. “It will be bigger and better, there will be 50 to 100 employees, and it will be an active part of the community.”

Lomaz claims he didn’t hear about the current referendum until six weeks ago, but he’s no stranger to the controversy over zoning in Deerfield. Several years ago, he was a supporter of another zoning referendum which was defeated by voters, and later, he sued challenging the constitutionality of the zoning code.

He said he was already planning to come back to Deerfield, and crews are already starting the electrical work. However, his rebuilding efforts were stymied because the zoning code limited how much he could rebuild. Now, he said, he can rebuild all 28 buildings on his property.

“I’ve never dealt with such archaic zoning in all my life,” he said, claiming that the code discourages business growth. “What we were pleased with is that the voters of Deerfield township are fed up with the state of affairs, and they want change.”

He said not having zoning will encourage business development.

“That town has looked the same for 30 years,” he said. “It’s like the twilight zone.”

His neighbors, Doris and Jesse Carver, are not looking forward to the return of Midwest Fireworks. Their farm is across the street from the Lomaz property.

“He hates us because we stood up to him,” Doris Carver said. “I am worried about our property. He is mean, he is devious, he is evil ... That kind of thing attracts everything bad.”

She worries that a large strip of land which is for sale will be sold and turned into an adult bookstore or a bar, just to harass them.

“He will do that on purpose,” she said. “I’m going to be afraid to leave my house. He’s an evil, nasty person.”

Jesse Carver said he and his wife have owned their farm for 47 years, and are not moving. 

“Now, with no zoning, my God, he can do anything he wants,” he said.

Both are upset with Miles Felmly, the township’s fire chief, who had backed the zoning referendum.

Before the election, Deerfield residents got a letter urging them to support the zoning repeal. The letter was not signed, and did not have the name of a committee that paid for it, which Carver believes is a violation of election laws. He plans to challenge the mailing before the Ohio Secretary of State.

Ronald Crane, who was zoning inspector for 10 years, said the zoning will be officially repealed as soon as the votes are certified. 

The day after the election, Crane said, a man walked into his office, and said, “I voted to repeal zoning. How do we get it back?” Crane said he asked him why he supported the repeal if he wanted zoning.

Right now, Crane is keeping busy entering the township’s cemetery records into the computer. However, he said, he always considered zoning a “volunteer job” because the pay averaged out to about $1 an hour.

Fiscal officer Nancy Cowan said the township has spent $6,700 for zoning this year, and has taken in about $4,000 in permit fees.

Crane said Deerfield is now the only township in Portage County without zoning, although neighboring Berlin Center and parts of Smith township, both in Mahoning County, are without a zoning code.

The loss of zoning, he said, “set the township back 30 years.”

In a letter to the editor, Crane laments that he “apparently failed” the township, and “cannot express how sorry this makes me.”

He said the zoning referendum was initiated by the owner of a junkyard on S.R. 14 who was not permitted to expand onto a used car lot. However, he said, the junkyard still will not be able to expand because doing so is a violation of state law.

He dismissed complaints that zoning is enforced selectively as “totally untrue.”

“You’d be surprised how many people would come in and want us to make exceptions to the rules,” he said. “I used to tell them I didn’t have the authority to do that.”

He Was Only there One day a week. Tuesdays. For a couple hours.....

Ron Was the assistant. But was such a pain Frank quit. When they Tried to hire a Female assistant. He ran her off with his Attitude. Hey Good Riddance to the Petty Tyrant...

If we wanted To have Nit picky people - Trusties - Neighbors on your back all the time for everything. We would have built in stow or Hudson. Yes People Of All Walks of Life Didnt like how the zoning was handled out here...

Not Just the people trying to expand pig farms or junk yards.

Ron was Such a power Hungry Tyrant He cost Deerfield zoning.

Funny How Jessie carver can have a business. When No one else can... Selling LAWN mowers. Yep No farmer uses them to Farm. But I am betting he called them agricultural.

What the main Problem was. Power as the saying goes power corrupts. Absolute power corrupts absolutely.

Why Did Ron to the Job if It paid so little? CAUSE he got his ROCKS off Being in charge of his little Burg. LOVED the Power of it... Thats why he was there.

Ronald Crane and his Historical society buddies wanted the century home on the circle. So They Gave him a $100 a day fine for years.

Then when it was over $100,000 they took that mans house. To redo it... There are TONS of messy yards in deerfield. Do they get a $100 a day fine too.?? No.
They Didnt like the guy that owned it. He wouldnt bow down to the mighty powers of Deerfield. So They Took his house. While letting
TOns of others get away with the same thing they took his house for..

If you are friends with people in power. you can live in a Little Camping Trailer. WHen everyone else needs at least a double wide Manufactured home.

The Laws were made up and enforced by a few narrow minded Simpletons.... which Now has cost all of Us with the Repeal Of Zoning.

Having equitable Zoning laws Would Be a Good thing.

Maybe we can Have an ONLINE website were EVERYONE can see what the laws will be. Then we can get everyone on the same page. Only then WOuld I vote to reinstate zoning. If NOt you will have the same.

People with nothing better to do than Boss people around enforcing them again.

I pity any fool who does business with Larry Lomaz. He seems to only pay his debts after being taken to court. Just look at the large number of civil actions against him in Portage, Summit, and Cuyahoga counties alone, and anyone can see what a crook the guy is.

OH YA 1 MORE THING, MOST OF THE BOARD WERE RETIRED SO IT WAS ALMOST IMPOSSIBLE TO GET THEM ALL TOGETHER AT THE SAME TIME. WE GOT OUR PERMIT BECAUSE THEY CONTACTED THE MEMBERS WHO WERE IN FLORIDA AND GOT THEIR APPROVAL.

HERE IS MY TAKE ON THE ZONING BOARD, GOOD RIDDENS: I AS A CONTRACTOR TRIED TO GET A ZONING PERMIT FROM DEERFIELD AND IT TOOK 4 MONTHS, YOU ASK WHY - OK HERE IT IS - I SUBMITTED THE ZONING APPLICATION AND IT NEEDED A VARIANCE AND APPROVAL FROM THE BOARD. WE HAD ALL THE NEIGHBORS OK IN WRITING SO WE WENT TO THE MEETING, THEY COULDNT APPROVE IT BECAUSE HALF THE BOARD MEMBERS WERE NOT PRESENT, NEXT MONTH, SAME PROBLEM, THIRD MONTH. SAME PROBLEM SO FINALLY I CALLED THE HEAD OF THE ZONING BOARD AND GUESS WHAT, MOST OF THE BOARD WAS IN FLORIDA ON WINTER VACATION. I TOLD HER THAT WAS NOT MY PROBLEM AND I NEEDED A PERMIT. WELL I CALLED PC PROSECUTER AND HE MADE A CALL AND THREATENED THEM WITH A LAWSUIT IF THEY DIDNT GIVE ME A PERMIT. I GOT IT THE 4TH MONTH.

I think that it is really sad the we no longer have zoning in Deerfield. There must be more scum in our community that do not care about their property than those of us who do. As for the "twighlight remark--apparently you do not notice all the new homes and let me see the circle has a couple of new businesses". As for the shrub issue if you would read the zoning book you would understand that it is not for personal property but businness as a buffer to the main roads and personal property around them.
I am sure Larry will bring in jobs lilke last time--not all of which were legal.
Way to go Deerfield!

people are so mean...practice safety and there wont be no blown off fingers...I would welcome him back in a heartbeat and I would work for him, not thinkin twice about it either....
